1. Acceptance of Terms

By accessing or using FWD (the "Service"), provided by Terrafic Insights Pvt Ltd ("Company", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Service Description

FWD is an Outcome Acceleration Platform that provides AI-powered strategic planning, research capabilities, and execution management tools to help organizations accelerate their business outcomes. The Service includes market research, strategic option generation, OKR management, and related business intelligence features.

3. Eligibility and Account Registration

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate and complete registration information
• You will maintain the security of your account credentials
• You are responsible for all activities that occur under your account

4. Credit System and Payment Terms

FWD operates on a credit-based system:

• New accounts receive 10 free credits for evaluation purposes
• Platform usage fee of 1 credit is charged every Friday
• Additional credits can be purchased through the platform
• Credits are consumed for AI-powered operations including research, analysis, and strategic planning
• Credits and platform usage fees are non-refundable

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload or share malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the Service for illegal activities or to harm others
• Reverse engineer, modify, or create derivative works of the Service
• Resell or redistribute the Service without written permission
• Use automated tools to extract data from the Service

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Terrafic Insights Pvt Ltd and are protected by intellectual property laws. You retain ownership of any content you upload or create using the Service. By using the Service, you grant us a limited license to process your content to provide the Service.

7. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by ourPrivacy Policy, which forms part of these Terms. You own all strategic plans, research data, and other content you create using the Service.

8. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance when possible.

9. Limitation of Liability

To the fullest extent permitted by law, Terrafic Insights Pvt Ltd shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Any damages exceeding the amount paid by you in the 12 months preceding the claim
• Actions of third-party services integrated with the platform

This limitation does not apply to damages arising from data breaches due to our negligence or willful misconduct.

10. Account Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. You may terminate your account at any time through your account settings. Upon termination, your access to the Service will cease, and your data will be deleted according to our data retention policy.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be resolved through good faith negotiations. If unresolved within 30 days, disputes shall be settled through binding arbitration in Bengaluru, Karnataka, India, in accordance with the Arbitration and Conciliation Act, 2015.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Karnataka, India, without regard to its conflict of law provisions. The courts of Bengaluru, Karnataka shall have exclusive jurisdiction over any matters not subject to arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
